Rent Arrears: Guarantees & Enforcement
By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:
The practical dilemma
The tenant has left following judgment but owes rent, municipal charges and damage costs. How can the debt be pursued?
The legal position
A cheque or promissory note may support an Enforcement Office file, but the debtor may object on contractual or debt-related grounds. The claimed sum and conditions of realisation must be checked, including applicable tenancy safeguards. A fixed-sum claim is available only within its requirements. Attachments and collection remain subject to notices, orders and statutory limits. Possessing a cheque does not guarantee recovery or justify duplication. Official source 1 Official source 2
Your next step
Prepare an itemised account with payments, invoices and exact periods. Compare instrument enforcement, fixed-sum proceedings and an ordinary claim, and review guarantors and security. Track service and objection dates and avoid enforcing beyond the substantiated debt.
