Defamation Demands & the Streisand Effect
By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:
The practical dilemma
A scarcely noticed post becomes widely shared after an aggressive legal demand is published online.
The legal position
The Streisand effect describes a communication risk, not a legal presumption or universal reason to avoid proceedings. Claims, defences and remedies require examination. Litigation may increase access subject to publicity rules and orders. Demands, platform requests and agreements can be appropriate but do not guarantee removal or secrecy. Crisis strategy must weigh both legal harm and public exposure. Official source 1 Official source 2
Your next step
Document the audience and define the objective: removal, correction, compensation or prevention. Assess alternatives before a public response and coordinate legal and communication measures without unsupported threats or republishing the harmful material.
