A commercial judgment appears to apply an incorrect legal interpretation despite relevant Supreme Court authority.
The legal position
Basic Law: The Judiciary section 20(b) makes Supreme Court precedent binding on other courts. Identify the actual rule and its factual fit, rather than a similar isolated sentence. Lower-court authority has a different status. Even a legal error must affect the result or relief; an appellate court may uphold the outcome on another basis.
