Restraining Orders & Firearm Restrictions
By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:
The practical dilemma
Police require surrender of a licensed firearm following a protection application. Has the licence been permanently lost?
The legal position
Weapon restrictions under a family protection order are addressed by section 2B of the Family Violence Law, with applicable exceptions. A harassment-prevention order may include restrictions under section 5(a)(4) of that law. These are distinct from a separate licensing decision. Surrender, variation and licensing review have their own procedures and deadlines; an interim order does not automatically revoke a licence permanently. Official source 1 Official source 2
Your next step
Comply with surrender directions and obtain written confirmation. Identify whether the restriction comes from the court order, licensing decision or both. Gather licence and employment documents and pursue the appropriate application without carrying a weapon while prohibited.
