Previous Counsel Fees & Reasonable Payment
By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:
The practical dilemma
Your current lawyer claims all future fees and success payments will remain payable if you leave.
The legal position
Ending representation does not necessarily eliminate fee obligations. Binish-Adiel, Civil Appeal 136/92, and Corfu, Civil Appeal 8854/06, examine termination and financial consequences in light of the contract, work, reason and good faith. There is no rule invariably limiting recovery to reasonable remuneration or requiring every future payment. Contractual issues may arise where completion is prevented. Official source 1
Your next step
Collect the agreement, invoices, work records and reasons for change. Request an itemised account and compare contractual terms with work performed. Document the transfer and account without allowing the dispute to obscure court dates.
