The practical dilemma

A non-paying tenant refuses to leave and argues that litigation will take years. What does the dedicated possession route provide?

The legal position

Civil Procedure Regulation 81 provides a specific route for non-protected tenancies. A defence is due within 30 days of service; the hearing is intended to be fixed within 30 days of the last defence deadline, subject to applicable rules and orders. This does not guarantee physical eviction within 60–90 days. Monetary remedies are pursued separately. Judgment and Enforcement Office implementation involve distinct notice and timing requirements.
