Focused Appellate Grounds & Legal Errors

By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:

The practical dilemma

You want to challenge every paragraph in a lengthy appeal, hoping that one of many arguments will persuade the court.

The legal position

Regulation 134 governs structure and length, depending on the court and its directions. State the relief, essential decision and reasons concisely. An appeal does not reopen the entire file or permit new evidence without authorisation. A procedural defect should be linked to the outcome. Form defects may prompt correction or other orders, rather than automatic invalidation in every case. Official source 1 Official source 2

Your next step

Rank errors by significance and effect, using precise references to the existing record. Check page and appendix limits. Consider a separate reasoned application for new evidence or additional length.
