Interim Property Injunctions & Evidence
By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:
The practical dilemma
A co-owner or defaulting seller intends to transfer the property tomorrow. How can you seek to preserve your rights?
The legal position
Interim relief protects the ability to implement a later judgment; it does not establish victory in advance. Civil Procedure Regulations 95–97 require consideration of a prima facie claim, necessity, balance of convenience, good faith and delay. The other party is generally heard; without-notice relief is exceptional. Regulation 96 governs undertakings and security, whose type and amount the court determines. No universal bank-guarantee or final-decision timetable applies. Official source 1
Your next step
Collect evidence of your right and the imminent risk, explain why later compensation may be inadequate and disclose adverse facts as well. Urgency supports prompt action but does not replace a substantiated application.
