The practical dilemma
An injunction or attachment disrupts your transaction or business. Must you wait for final judgment?
The legal position
In ordinary civil proceedings, Regulation 137 generally provides 60 days from service for leave applications, rather than a universal 30 days. Special law and calculation matter. Courts Law sections 41(b) and 52(b) address immediate review, including substantial prejudice or an unnecessary or incorrect proceeding if review waits. Irreversibility is important but not the entire test; alleged error alone does not require leave. Official source 1 Official source 2
