A prosecution notice offers 30 days to submit arguments before indictment. Should you respond or reserve the defence for trial?
The legal position
Section 60A of the Criminal Procedure Law 1982 governs notice of investigation-material transfer in felony matters and arguments within 30 days of receipt, subject to exceptions. Extensions can be requested, and early indictment may be authorised by a reasoned decision. The framework does not apply identically to every suspect, including certain detained suspects. Full disclosure under section 74 is not automatic before indictment; hearing disclosure depends on guidance and circumstances. Official source 1
