The practical dilemma
A receiver is appointed. How are fees determined, and can an existing owner bid for the property?
The legal position
The appointing court’s directions, bidding terms and sale approval govern the process. The Land Law does not fix every receiver’s fee at 2%–4%; the applicable framework and work undertaken matter. A co-owner may bid within the rules, but has no automatic priority or right to offset their share against every deposit or payment. The highest bid still requires judicial approval and compliance.
