Stay of Execution: Prospects & Convenience

By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:

The practical dilemma

A substantial payment or demolition judgment enters enforcement despite your appeal. Can the position be preserved?

The legal position

The general civil source is Regulation 145, not a statutory “section 145”. Filing does not stay execution. Prospects and balance of convenience interact, sometimes with the latter dominant; there is no numerical formula. The competent court changes with filing status. Relief may be full, partial or conditional, and a stay differs from other interim measures. Official source 1

Your next step

Gather the judgment, implementation date and evidence of harm and the parties’ position. Present genuine grounds and proportionate relief. File in time in the proper court and comply with the eventual order’s conditions.
