Civil Appeal Deadlines & Security for Costs

By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:

The practical dilemma

You are considering options after an adverse judgment and assume an extension will always be available.

The legal position

Civil Procedure Regulation 137 generally provides 60 days from service for a civil appeal or leave application, not every legal procedure. Special rules, service, recesses and emergency provisions require review. Regulation 176(b) requires special reasons for extending a statutory period. Regulation 135 governs security and possible variation or exemption. Failure to deposit can endanger the proceeding, without an identical automatic outcome in every case. Your next step

Record service and check the specific deadline and security. Apply promptly with supporting grounds for any extension or relief. Do not postpone deadline review while arranging finance or resolving the previous representation.
