Staying Money Judgments or Eviction Orders

By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:

The practical dilemma

Is staying a major monetary payment easier than staying the loss of a home?

The legal position

Money judgments are generally not stayed because repayment may restore the position, but substantiated recovery difficulty or exceptional harm can matter. Eviction, sale and demolition may be harder to reverse without creating automatic entitlement to a stay. The other party’s rights and appeal prospects remain relevant. General hardship assertions may be insufficient; partial relief can balance risk. Official source 1

Your next step

Provide financial evidence and concrete recovery or harm concerns. Assess partial payment, deposit or temporary preservation. Act before planned sale or possession and review the separate enforcement process.
