False Google Reviews & Business Defamation

By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:

The practical dilemma

Reviews accuse your business of dishonesty and enquiries fall. How can lawful criticism be distinguished from defamation?

The legal position

Consumer criticism can be legitimate without absolute immunity. Consider the reasonable reader, factual allegations, identification and context. Section 14 requires truth and public interest together; sections 15–16 make good-faith defences circumstance-dependent. A star rating alone is not necessarily defamatory. Genuine dissatisfaction differs from an invented incident, and commercial loss requires an appropriate foundation. Official source 1 Official source 2

Your next step

Keep the review, service records and customer correspondence. Separate verifiable facts from opinion. Consider a measured response, correction or legal action without exposing the customer’s personal information.
