Workplace Email Defamation & Reply-All
By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:
The practical dilemma
A manager’s company-wide email attributes a failed project to your alleged dishonesty or incompetence.
The legal position
An internal email can constitute publication. Meaning, context and recipients require review. Section 15(7) may protect qualifying supervisory opinion, subject to good faith and reasonable scope under section 16. It does not authorise indiscriminate unverified factual accusations. Equally, legitimate professional criticism is not automatically unlawful merely because it is unwelcome. Official source 1
Your next step
Keep the email chain and recipient list. Distinguish performance assessment from factual accusation and identify the proper internal channel. A focused response may limit harm; avoid unnecessary reply-all exchanges.
