Workplace Defamation: Which Court?
By Adv. Yechiel Rachamim Menahemov & Adv. Assaf ShpigelPublished:
The practical dilemma
A harmful workplace publication raises a claim. Which court has jurisdiction?
The legal position
Labour Court Law 1969 section 24(a)(1D) gives exclusive jurisdiction over specified employment-related defamation claims between employees and employers or defined office-holders, including certain supervisors. It does not cover every colleague identically. Review parties, roles, employment connection and remedies. A jurisdictional error does not necessarily end the claim permanently; transfer may be available. Official source 1
Your next step
Map the parties’ roles at the relevant time and collect role and publication evidence before filing. If already filed in the wrong forum, consider transfer and its timing consequences.
