The practical dilemma
Consultation was denied, requested footage was not collected or improper pressure was used, yet a conviction followed.
The legal position
Issacharov and Hayvatov emphasise fairness and consultation. Exclusion under case law and Evidence Ordinance section 56A involves judicial assessment, not automatic removal for every defect. Voluntary confession under section 12 is a separate issue. Investigation omissions may affect weight or defence without invariably creating reasonable doubt.
