The legal position
Criminal Procedure Law sections 199–200 generally provide 45 days from judgment, with service rules where it was not delivered in the defendant’s presence and special arrangements to check. Do not import the civil 60-day period. Conviction, sentence or both may be challenged. Neither better sentencing prospects nor an automatic custody stay should be assumed.
