The practical dilemma
A restaurant, venue or garage operates while licensing is pending. An indictment seeks closure before conviction.
The legal position
The Business Licensing Law 1968 regulates unlicensed operation, including section 14. Check temporary or other valid permission as well as a permanent licence. Section 16 concerns post-conviction orders; section 17 concerns orders after indictment but before conviction, alongside other closure routes. Strict-liability offences require consideration of Penal Law section 22 and available defences. Later permission does not automatically erase an earlier offence. Official source 1 Official source 2
