The practical dilemma
A case closes for insufficient evidence. What information remains and can the closure ground be changed?
The legal position
Criminal Procedure Law section 62 distinguishes absence of criminal guilt, insufficient evidence and circumstances unsuitable for prosecution. Changing the ground affects the relevant record, without necessarily deleting every investigation document. A suspect’s ground-change request differs from a complainant’s appeal against closure under sections 64–65. The evidence and guidance determine the review, rather than the mere absence of indictment.
